Krisha Jethani is an India-qualified Advocate in the Commercial Dispute Resolution team with a focus on cross-border litigation and international arbitration.

She advises on a broad range of commercial disputes including contractual disputes, civil fraud and corporate disputes.

Her experience includes various commercial litigation and arbitration mandates, and extends to corporate insolvency, private law and family disputes. She has a keen interest in international commercial arbitration, as well as finance and fin-tech disputes.

Prior to joining Howard Kennedy, Krisha worked as an Associate and Articled Clerk at a boutique litigation firm in Mumbai. During her time there, Krisha acted for large corporations, HNWIs and real estate developers at the Bombay High Court, the Supreme Court of India and the National Company Law Tribunals.

Krisha co-authored "Cutting the Gordian Knot: Indian Parties in Foreign Seated Arbitrations", Asian Dispute Review (July 2021), Hong Kong International Arbitration Centre.

Krisha has a BLS LLB from Government Law College, University of Mumbai, and qualified in India in 2019. Krisha recently graduated with a Commercial LLM from the University of Cambridge.

Recent work

  • Represented a German wind energy company in enforcing a US$5 billion LCIA award in India.
  • Defended an Indian hotel owner party to a hotel management agreement against interim relief proceedings initiated by the counter-party multinational hospitality company under a dispute resolution clause in the background of Covid-19 disruptions.
  • Second chair in an ad-hoc arbitration defending an interior designer in proceedings invoked by its client seeking damages for breach of contract.
  • Successfully defended an erstwhile princess in arbitration proceedings invoked by a construction firm to specifically enforce a development agreement.
  • Acting on an urgent basis for the third defendant facing a US$1bn worldwide freezing order, based on an alleged fraud in the Indian diamond industry. Different aspects of the dispute have been on foot for nearly 10 years across India, the UAE, Singapore, various offshore jurisdictions and now England. It involves complex points of insolvency law, and a jurisdiction challenge based on abuse of the English insolvency regime.
  • Acting for three connected entities within a large and high-profile multi-national financial services group, headquartered in India, as defendants in a c.£45m fraud claim related to the massive international Wirecard alleged fraud.
