This session will explore the complex realities of cross-border asset recovery in the aftermath of fraud. Drawing on real-world case studies, our expert panel will delve into the legal, commercial, and practical challenges of enforcing international judgments against parties who go to great lengths to conceal assets or frustrate enforcement efforts.
With themes such as the reputational and non-legal options available to creditors, limitations of enforcement mechanisms in key jurisdictions, and the increasing use of sovereign immunity to shield assets, this discussion will move beyond the textbook to the trenches.
This is not a standard case study session. Instead, the panel will use high-level, anonymised scenarios to drive an interactive and dynamic discussion on how legal teams can adapt their strategies to stay ahead of bad actors in global enforcement.

2. Climbing the Walls: Navigating Obstacles in a Cross-Border Insolvency Strategy

Cross-border insolvency often presents a unique set of challenges, from evidentiary roadblocks to jurisdictional complexities. In this interactive session, we'll explore some of the key obstacles that clients and advisors may face when implementing a successful cross-border insolvency strategy.
Using a fictitious case study as a springboard, our panel of legal and forensic experts will draw on their deep, practical experience to guide attendees through common pitfalls and complications. The discussion will cover the difficulties in gathering and submitting evidence for disclosure, the impact of conflicting jurisdictional rules on the ability to obtain critical information, and issues surrounding collateral use and interference from bad actors.

3. Specialist Arbitration Practices: Essential Expertise or Industry Illusion?

This event will feature a lively debate on the value and necessity of specialist arbitration practices, seeking to debate the following motion: "This house believes that there is no such thing as an arbitration specialist – any commercial litigator can do the job."
On one side, Arish Bharucha and Hannah Brown KC will argue in favour of the motion. Namely, that the concept of there being a benefit to clients in engaging a specialist arbitration practitioner is an industry illusion and that the push for specialisation could be driven more in the interests of arbitration professionals than by actual necessity.
On the other side, Dharshini Prasad and Joanne Clarke will argue against the motion, with the aim of proving that specialist arbitration practices bring essential expertise and industry knowledge to complex cases, providing clients with the benefit of their in-depth knowledge of arbitration procedure.
This event promises to offer insightful perspectives and foster engaging discussions on the importance (or not!) of specialisation in arbitration.
